Important Notice: BareStone Investments is a real estate investment company, not a licensed real estate brokerage. We purchase properties directly. These Terms govern your use of our website and all interactions with us. By submitting a property inquiry, you confirm you have read and agreed to these Terms. Consent to receive communications is not required as a condition of any transaction.
Section 01

Acceptance of Terms

By accessing or using the BareStone Investments website (the "Website"), submitting a property inquiry, engaging with our chat widget, or interacting with us in any way, you ("User," "you," or "your") agree to be legally bound by these Terms and Conditions ("Terms"), our Privacy Policy, and all applicable federal, state, and local laws and regulations.

If you do not agree to these Terms in their entirety, you must immediately cease using this Website and must not submit any information to us. These Terms constitute a legally binding agreement between you and BareStone Investments.

These Terms apply to all visitors, sellers, and others who access or use the Website. Your continued use of the Website after any changes to these Terms constitutes acceptance of those changes.

Nature of Services

BareStone Investments is a real estate investment company that purchases residential and commercial properties directly from sellers for cash. We are not a licensed real estate brokerage, real estate agent, or mortgage lender, and nothing on this Website should be construed as real estate brokerage services, legal advice, or financial advice.

  • Submitting a property inquiry to BareStone Investments does not create a real estate agency relationship.
  • We act solely as a principal buyer, not as your agent, representative, or fiduciary.
  • We do not list properties on the Multiple Listing Service (MLS) or market your property to other buyers.
  • We may assign our rights to purchase your property to another buyer as part of a wholesale transaction.
  • You are encouraged to seek independent legal, tax, or financial advice before entering into any real estate transaction with us.
Section 03

No Obligation

Submitting a property inquiry to BareStone Investments does not create any obligation on your part to sell your property, nor does it create any obligation on our part to make an offer or purchase your property.

  • All cash offers presented by BareStone Investments are non-binding until a written Purchase and Sale Agreement is fully executed by both parties.
  • Any offer we present is subject to property inspection, title review, lien searches, and final due diligence.
  • We reserve the right to modify or withdraw any offer prior to execution of a written agreement without liability to you.
  • You are free to reject any offer we make, seek offers from other buyers, or choose not to sell your property at any time before signing a purchase agreement.
Section 04

Accuracy of Information

You represent, warrant, and covenant that all information you provide to BareStone Investments — including but not limited to information about yourself, your ownership of the property, the property's condition, any liens or encumbrances, and any pending legal matters — is accurate, complete, and truthful to the best of your knowledge.

⚠️ Important: Providing false, misleading, or materially incomplete information may result in rescission of any offer or executed agreement, forfeiture of any earnest money deposit, and potential exposure to legal liability including claims for fraud or misrepresentation.

You further represent and warrant that you are the legal owner of the property, or that you are authorized to act on behalf of all legal owners, and that the property is not subject to any undisclosed pending litigation, foreclosure action, or court order that would prevent or delay a sale.

Section 05

Communication Consent

By providing your phone number and/or email address and checking the consent checkboxes on our property inquiry form, you expressly consent to receive the following communications from BareStone Investments:

  • Automated and manually dialed telephone calls to your provided phone number.
  • Pre-recorded voice messages.
  • SMS and MMS text messages, including messages sent via automated telephone dialing systems.
  • Email communications to your provided email address.

These communications may include: property offer details, appointment confirmations and reminders, follow-up inquiries, transaction updates, and general communications related to BareStone Investments' services.

Opt-Out: You may opt out of SMS communications at any time by replying STOP to any text message. You may opt out of email communications by clicking the unsubscribe link in any email. Standard message and data rates may apply. Consent to receive communications is not a condition of purchasing or selling any property.
Section 06

As-Is Purchases

BareStone Investments purchases properties in their current "as-is" physical and legal condition, unless otherwise expressly agreed in a written Purchase and Sale Agreement. This means:

  • We do not require sellers to make repairs, renovations, improvements, or clean-outs prior to closing.
  • Our cash offer reflects our assessment of the property's current condition, our estimated cost of repairs, our cost of carrying the property, and our projected resale value.
  • We may conduct a property walkthrough or inspection before finalizing an offer. This inspection is for our benefit and does not create any representation or warranty regarding the property's condition.
  • Sellers are responsible for disclosing all known material defects, environmental issues, code violations, liens, judgments, or other encumbrances affecting the property.
Section 07

No Guarantee of Purchase

Submitting a property inquiry, receiving a preliminary offer, or entering into preliminary negotiations with BareStone Investments does not guarantee that we will complete a purchase of your property.

We reserve the right to decline any property or withdraw any offer at any time prior to execution of a written Purchase and Sale Agreement for any reason, including but not limited to:

  • Discovery of title defects, undisclosed liens, or encumbrances.
  • Unfavorable inspection findings or material misrepresentations about the property's condition.
  • Inability to obtain satisfactory title insurance.
  • Changes in market conditions or our investment criteria.
  • Legal or regulatory restrictions affecting the property or the transaction.

Intellectual Property

All content on this Website — including but not limited to text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software — is the property of BareStone Investments or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Website for personal, non-commercial purposes only. You may not:

  • Reproduce, copy, distribute, or sell any content from this Website without our prior written permission.
  • Use our name, logo, or branding in any way that implies endorsement or affiliation without our consent.
  • Scrape, crawl, or use automated tools to extract data from this Website.
  • Frame or mirror any portion of this Website without our written consent.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BARESTONE INVESTMENTS, ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, AGENTS, OR SUCCESSORS BE LIABLE FOR ANY:

  • Indirect, incidental, special, consequential, exemplary, or punitive damages.
  • Loss of profits, revenue, data, business opportunities, or goodwill.
  • Damages arising from your use of or inability to use this Website or our services.
  • Damages arising from any transaction, offer, or communication related to our services.
  • Damages arising from unauthorized access to or alteration of your data or transmissions.
Liability Cap: In all cases, BareStone Investments' total aggregate liability to you for any and all claims arising from your use of this Website or our services shall not exceed One Hundred Dollars ($100.00), regardless of the form of action or the basis of the claim.

Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations may not apply to you in full.

Governing Law & Dispute Resolution

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflict of law principles.

Any dispute, claim, or controversy arising out of or relating to these Terms, your use of the Website, or any transaction with BareStone Investments shall be subject to the exclusive jurisdiction of the state and federal courts located in Franklin County, Ohio. You hereby irrevocably consent and submit to the personal jurisdiction of such courts.

By providing your phone number and checking our consent checkboxes, you acknowledge and agree to the following:

  • You are the subscriber or primary user of the phone number you provided, or you are authorized to provide consent on behalf of the subscriber.
  • You expressly consent to receive autodialed calls, pre-recorded messages, and SMS/MMS messages from BareStone Investments at that number.
  • Your consent is not conditioned upon purchasing any goods or services from us.
  • You may revoke your consent at any time by replying STOP to any text message or contacting us directly.

Severability

If any provision of these Terms and Conditions is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable under any applicable law, such provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, it shall be severed from these Terms.

The invalidity or unenforceability of any provision shall not affect the validity or enforceability of any other provision, and the remaining provisions of these Terms shall continue in full force and effect.

Entire Agreement

These Terms and Conditions, together with our Privacy Policy and any written Purchase and Sale Agreement you may enter into with BareStone Investments, constitute the entire agreement between you and BareStone Investments with respect to your use of the Website and your interactions with us, and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral.

No waiver by BareStone Investments of any term or condition set out in these Terms shall be deemed a further or continuing waiver of such term or condition, and any failure by BareStone Investments to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.
